Tipperary girl with cerebral palsy settles case against HSE

The High Court was told by senior counsel for Katie Manton from Cashel that the Manton family thought the apology was too little too late.

7 year old Katie from George's Land, Dualla Road, Cashel has cerebral palsy – she took the case against the HSE through her father Raymond.

They sued over the alleged below standard management of her mother Aoife's obstructed labour and the excessive delay in delivering Katie at South Tipp General Hospital on September 17th, 2008.

The court heard that Katie had suffered a lack of oxygen to the brain during the birth and is severely and permanently disabled.

The general manager of South Tipperary General Hospital, Grace Rothwell, told the court she wished to express the HSE's sincere and unreserved apologies for the failings that caused the injuries to Katie and the tragic outcome.

The Manton family described the HSE's apology as too little too late in the circumstances.

Mr Justice Kevin Cross approved the settlement of €6.7 million and said her parents had brought Katie through the early years and that they were the heroes.
