Solicitor warns of repercussions over suspended sentence ruling

Judge Michael Moriarty struck down Section 99 of the Criminal Justice Act; he found that the instant activation of suspended sentences where a criminal is found guilty of a new crime was unconstitutional. 

Minister for Justice Frances Fitzgerald has said that if legislation is necessary to address the ruling, then it can be introduced in the Dáil within days.

However Clonmel solicitor Kieran Cleary, speaking on Tipp Today, said it's not that simple because we don't have a proper Government in place.
