Permanent enforcement orders issued on two Tipp financial companies

The matter was before the courts today and restrains Smart Resolutions Mediation Limited, Clonmel C&R Management Consultants Ltd and Geraldine Quigley from carrying on the business of a debt management firm.

Proceedings against Thomas and Cathal Quigley were struck out.

Last August, the Central Bank issued a warning that Smart Resolutions Mediation Limited, founded in Clonmel but based in Cashel, was not an authorised debt management firm and to operate as such was a criminal offence.

It subsequently sought and was granted two interim enforcement orders against the company and another; Clonmel C&R Management Limited – of 12 Ash Court Clerihan and Geraldine Quigley.

The financial institution took the action on foot of what it described in court as “information of an urgent and compelling nature in relation to Smart Resolutions after it “continued to receive and investigate reports alleging that Smart Resolutions” and persons associated with that firm continued to provide debt management services”.

The matter was back for hearing at the High Court today where the interim enforcement order against the two firms and Ms Geraldine Quigley was made permanent by agreement with these parties. 

It restrains them from carrying on the business of a debt management firm or any regulated business unless authorised to do so by the Central Bank.

Any allegations of impropriety were vigorously contested on an affidavit by Geraldine Quigley while proceedings against Thomas and Cathal Quigley – named directors of the firms-were struck out entirely.
