Michael Lowry appeals judgement on costs challenge

The Tipperary TD was only given a third of his costs after it was decided the former Minister for Communications didn't co-operate fully with the inquiry 

Deputy Lowry claimed he had been discriminated against in the decision – it's thought his legal fees are between €5 and €8 million.

In a statement to Tipp FM this evening Michael Lowry said he was naturally disappointed at today’s judgement.

The High Court rejected his appeal stating the tribunal decision on costs “was fair and reasonable”

In his ruling Mr Justice John Hedigan said Mr Lowry had failed to demonstrate any “unreasonableness or discrimination” in the inquiry's decision on legal fees.

Having considered the ruling, Michael Lowry says his legal team has advised him to appeal the decision on a number of substantive grounds adding they are already preparing an appeal for the Court of Criminal Appeal.

In a statement to Tipp Fm the Tipperary TD says no matter what way the Court decided today, “this case was always one that was going to be brought by either side to the highest level for a final decision.”

The former Communications Minister went on to expressed particular concern that, in his opinion, “the judgement today erroneously claims that the Tribunal had made a finding that he had been engaged in bribery and perjury”. 

The Independent TD says the Tribunal never made and could not have made any such finding and it is a matter of the gravest concern that such a damaging claim has been made.
