Tipperary TD seeks to have case struck out

Legal submissions regarding Tipperary TD Michael Lowry's upcoming trial will continue next month.

The Independent TD of Glenreigh, Holycross is facing a total of four charges of knowingly or wilfully making incorrect returns between 2003 and 2007.

In outlining their application, Mr Lowry's legal team said they were seeking to have the matter either struck out or put a permanent stay on proceedings.

Defence Council Patrick Treacy told the court the application was on two grounds – details of which are being outlined this afternoon- during legal submissions in July regarding this mater, he told Judge Tom Teehan that the case was tainted and corroded with illegalities.

He also claimed that biased media coverage could derail the trial which he described as cancerous due to the disclosure of the Independent TD's financial affairs.

Judge Teehan is also due to rule on a DPP application to have the case transferred to Dublin as Council for the state says it would be manifest injustice if it proceeded in this jurisdiction given a substantial number of potential jurors would have already “sat in judgement of him” ( Michael Lowry) via the ballot box

The matter has been adjourned until Monday the 10th November
