Tipperary man takes successful appeal against prison sentence

He was sentenced to four years in prison for the offence in June of last year – at the time Judge Tom Teehan suspended the final 12 months.

55 year old Fogarty won his appeal on the grounds that the judge erred in placing the offence at the most serious end of the range.

It has now been reduced to three years with the final 12 months suspended.
