Housing Minister Simon Coveney has introduced a second amendment to correct the error after his first attempt last night raised fresh concerns.
Meanwhile it looks like TDs may have to return to the Dáil next Monday to pass the legislation.
The housing minister's new proposals do close any possible loopholes, but Fianna Fáil's Barry Cowen suggested the original error may have been deliberate:
TDs continue to debate the legislation – there hasn't been a vote yet, there's still a further 116 amendments to debate and vote on, the Dáil is not expected to sit past 6pm today and a sitting on Monday to complete this legislation is likely.
