Judgement against Michael Lowry set aside.

The Master of the High Court had last year granted the judgement to BBT Chartered Accountants against Deputy Michael Lowry for fees claimed for work carried out by them relating to the Moriarty Tribunal.

Foxrock based BBT had sought judgment for €1.74 million but the issue of whether it was entitled to judgment in the remaining sum was adjourned for a full hearing.

At the hearing in November Michael Lowry's legal team indicated they would be appealing the judgment on the grounds that the Master lacked the jurisdiction to make the order.

They also claimed if a stay was not put on entry of judgment, it would cause harm to the Thurles based TD and put him to considerable cost, inconvenience and embarrassment.

This week the High Court Deputy Master vacated the judgment order and all matters will now be decided at a full court hearing – the case will come before the court again next November.
