Final settlement approved in action against HSE over Tipperary birth.

A young Tipperary girl with cerebral palsy has settled her action against the HSE for damages sustained at her birth.

Eight year old Kate Murphy from Fethard suffered brain injuries when she was born at South Tipperary General Hospital in 2005.

This final settlement of €4.85 million brings to 6.5 million the total amount paid to Kate Murphy of The Valley, Fethard who had sued the HSE through her mother Sarah over alleged negligence and breach of duty in the circumstances of her birth.

The court had previously heard the Murphy family wanted to finalise the legal action with a lump sum payment rather than return to court for interim payments every few years.

Mr Justice Kevin Cross yesterday approved the final settlement at the High Court to bring finality to the situation rather than numerous applications in stages to the court.

In 2011 Kate received a €1.3 million interim payment and another €400,000 at a later stage.
