Both sides in Tipperary Traveller School appeal to pay own costs

The ruling by the five-judge court arises from proceedings brought on John Stokes' behalf by his mother Mary Stokes against the enrolment policy of CBS High School.

It had been claimed the school policy of giving preference to the children of past pupils indirectly discriminated against Traveller children.

The Supreme Court earlier this month found evidence and materials placed before the Circuit Court and Equality Tribunal were insufficient to enable them to properly assess if John Stokes was particularly disadvantaged as a result of neither his father nor another sibling having gone to the school.
