There’s mounting pressure this afternoon on the former Attorney General to step aside from her nomination to the Court of Appeal.

Máire Whelan was given the job in one of the last acts of Enda Kenny’s Cabinet last Tuesday.

It’s understood Fianna Fáil believes this issue could jeopardise the minority government.

Máire Whelan did not excuse herself from the Cabinet on Tuesday when it was decided she should be appointed to the Court of Appeal.

The former AG did not apply for the judicial role, which carries a salary of 180,000 euro a year.

Sinn Féin’s Mary Lou McDonald wants to hear from Taoiseach Leo Varadkar on whether he raised any concern about the appointment at Cabinet before he took over.

Labour leader Brendan Howlin thinks while Máire Whelan is qualified the way this was done is wrong.

The party’s insisting the appointment goes against its confidence and supply deal and if there’s not a resolution this could cause a general election.
