Following the judicial review the way has been cleared for the project to go to tender while compulsory purchase orders will also be undertaken.
The €40 million bridge and other works aim to ease the major traffic congestion in the twin towns of Ballina – Killaloe.
The project was delayed for a number of years following concerns raised by some local residents and environmental campaigners.
Acting Environment Minister and Tipperary TD Alan Kelly says the works will have a number of benefits to the area.
