North Tipperary County Council granted permission to Tom Ryan for the retention of works already carried out at a garage and retail outlet on the Limerick Road, Portryan in the town
The application also included a new extension to the rear of the building.
This has now been appealed to An Bord Pleanala by Hugh Sweeney of Portnacasky, Newport.
The state planning appeals board is due to rule on the case by mid-July.
