The 49 year old, who can't be named, denied a charge of rape and
sexual assault at his home in february of 2009.

The girl gave evidence that she had been drinking at the mans
apartment and fell asleep, she later woke up in his bed
with some of her clothes removed.

She went to leave, when the accused pushed her on the bed
and pulled down her trousers, she then left the apartment.

The court was told the man has since left Tipperary and now lives in
Waterford.

Justice Paul Carney described the incident as on the lower scale
of assault and remanded the man in custody for sentencing
next monday.
