The jury in the Central Criminal Court trial of a Tipperary man accused of the murder of Shane Rossiter in 2012 resume their deliberations this morning.
31 year old Maurice Power of Dranganbeg, Kilmoyler, Cahir has pleaded not guilty to murdering Mr Rossiter in the West Tipp village of Golden on October 17th of that year.
Ms Justice Deirdre Murphy told the jury yesterday that the case falls on the confession made by the accused during interviews with gardai in 2012.
She said they are either satisfied the confession is reliable in which case they convict or if they are not so satisfied, they acquit.
Justice Murphy said most of the circumstantial evidence connects the accused to a black Audi.which was at the scene of the killing – Maurice Power is said to have told Gardai he had gotten rid of the car by burning it and the clothes he had been wearing.
She went on to remind the jury that the prosecutions case deals largely with the confession – she then pointed out that the defence case is that the confession was unreliable.
The jury returned after more than one hour of deliberations yesterday and requested to see the interview in which the accused made a full confession to gardai as well as CCTV footage of the accused refueling the Audi at a petrol station.
The jury of seven women and five men retired for the day after more than two and a half hours of deliberations.
