The Independent representative is accused of breaking a number of tax laws arising from a 372,000 euro payment to his refrigeration company in 2002.
Holycross native Michael Lowry is facing a number of charges in relation to a payment of €372,000 that was owed to a company of his in 2002, and paid into an Isle of Man trust account – a move with tax implications, according to the DPP.
He claimed it has since been declared and questioned why the prosecution was going ahead after the Revenue Appeals Commissioner found he no longer had a tax liability.
The Tipperary TD also claimed he’d been denied the right to a fair trial and accused the DPP of punishing him for being popular with voters in his constituency by moving his trial to Dublin.
His case is due for mention before the Dublin Circuit Criminal Court tomorrow.
The High Court found in February that the arguments he made to prevent his trial from going ahead were devoid of any substance or merit.
Today, Mr. Seamus Noonan decided he hadn't raised any 'exceptional circumstances' that would justify not having to pay the other side's costs.
