A Tipperary resident who assaulted his then-wife has been remanded in custody for three weeks after the court heard his victim does not want him sent to jail.
Mihail Lurescu, with an address at Mitchel Street in Thurles pleaded guilty to assault causing harm of the woman at their former Dublin home in July 2013.
At Dublin Circuit Criminal Court, Gardaí gave evidence that on the 17th July 2013, the 28 year old began punching the woman in the head during a prolonged assault.
Afterwards, he told her to clean the blood off her face – when she went to call Gardaí, he took the phone off her and gave Gardaí the address. He then told the woman that he was going to jail anyway and punched her a number of other times in the head.
Mr Lurescu pleaded guilty to assault causing harm – when asked by Gardaí if he was sorry, he replied that 'a part of me is'.
The woman suffered a fracture to her cheek bone and bruising to her face…
Garda Enda Muldoon told Judge Martin Nolan that after speaking to the victim, he did not believe that jailing the 28 year old would help the family…the couple are now legally separated and have a child.
Judge Nolan told Mr Lurescu that he would finalise his sentence in three weeks and remanded him in custody until then….he said he wanted Lurescu to consider his situation and that the time in custody would warn him about embarking on this type of behaviour again.
Judge Nolan said that he would take it that there is little chance of Lurescu re-offending.
