Denis Landy was one of four party members absent for the proceedings which saw the government suffer an embarrassing defeat.

Last night Senators voted by a majority of 27 to 24 to pass a Bill brought by Fergal Quinn to ban upward only rent reviews in what's believed to be the first time the government lost a vote in the Upper House

Four members of the Labour Party – Tipperary's Denis Landy along with John Kelly, John Whelan and Jimmy Harte who were expected to attend – failed to show.

Their action comes ahead of polling day to abolish the Seanad and party sources believe its connected to resistance in the parliamentary party over the Referendum.

Senator Landy has already publicly stated that he's campaigning for a no vote – but this action could be seen as damaging to efforts to preserve the Upper House.

Whip Emmet Stagg is expected to meet with the four to seek an explanation for the actions and disciplinary procedures may follow.
