Labour TD Alan Kelly has published legal advice saying that a rent freeze is constitutional under certain conditions.
The Tipperary Deputy received the advice from then Attorney General Maire Whelan while he was the Minister for Housing.

It says a rent freeze should be defensible as a proportionate measure following market research and as long as it was minimally invasive on property rights.
Labour leadership hopeful Kelly says the measure can be brought in by the next government.
