McGrath critical of government powers

A Tipperary TD believes statutory instruments are ‘too powerful’ in bypassing planning legislation.

It comes after a group from Dundrum was refused an emergency injunction by the High Court to stop a change of use at the local hotel to house International Protection Applicants.

Mr Justice David Holland said the application in relation to Dundrum House Hotel simply did not have the necessary urgency, although the group was offered leave to appeal and time to apply for a full injunction.

Speaking on Tipp Today earlier, Independent Deputy Mattie McGrath says even the judge agreed about how the byelaw can bypass challenges in government.
