Tipperary man’s manslaughter conviction quashed.

 

 

A County Tipperary man is to be retried for the manslaughter of a woman who died in a house fire in April, 2007.

The Court of Criminal Appeal has quashed the conviction of Jason Murphy of Elm Park in Clonmel.

He was convicted by a jury in March 2010 of the manslaughter of Ann Marie O'Neill at Elm Park together with two counts of arson.

The original case heard that a fire had been started in a car owned by Ann Marie O'Neill's husband Pat which then spread to the house as the couple slept upstairs. 

39 year old Murphy was sentenced to 15 years for the manslaughter.

The three-judge Court of Criminal Appeal has now ordered that Jason Murphy's trial was unsatisfactory and that his convictions should be set aside, and ordered a retrial.
